Please read these terms carefully before using OnLocum's services.

1. Acceptance of Terms
By accessing or using OnLocum's platform, mobile applications, and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
These Terms constitute a legally binding agreement between you and OnLocum. We reserve the right to update these Terms at any time.
2. Description of Services
OnLocum provides the following services:
- Healthcare Staffing (Locum Tenens): Connecting healthcare facilities with credentialed professionals for emergency shift coverage
- Home-Based Care Coordination: Dispatching verified healthcare workers for clinician-directed services in home settings
- Medical Logistics Coordination: Coordinating delivery of supplies, specimens, and pharmaceuticals
- Workforce Trust Infrastructure: Credential verification, reputation tiers, and shift-performance tracking
- Facility Operations Integration: HMIS workflows and workforce management tooling (including FlowMed integrations)
- Emergency Services: Ambulance dispatch and emergency medical transport coordination
OnLocum acts as a technology platform connecting service providers with healthcare facilities and patients. We do not provide medical care, transport, or logistics services directly.
3. User Accounts
3.1 Account Creation
To use certain Services, you must create an account and provide:
- Accurate and complete information
- Government-issued identification
- Professional certifications (for healthcare professionals)
- Payment information
3.2 Account Security
You are responsible for:
- Maintaining confidentiality of your account credentials
- All activities under your account
- Notifying us immediately of unauthorized access
3.3 Age Requirement
You must be at least 18 years old to use OnLocum. Healthcare professionals must meet licensing requirements in their jurisdiction.
4. User Conduct
You agree not to:
- Provide false or misleading information
- Impersonate any person or entity
- Violate any laws or regulations
- Harass, abuse, or harm other users
- Use the platform for fraudulent purposes
- Interfere with or disrupt the Services
- Reverse engineer or attempt to access source code
- Use automated systems (bots, scrapers) without permission
5. Healthcare Services Disclaimer
IMPORTANT MEDICAL DISCLAIMER
OnLocum is a platform connecting healthcare facilities with professionals. We do NOT provide medical advice, diagnosis, or treatment. All healthcare services are provided by independent licensed professionals.
5.1 Professional Verification
OnLocum verifies professional credentials, but facilities are responsible for:
- Final credential verification
- Compliance with local licensing requirements
- Professional liability insurance
- Patient safety protocols
5.2 Emergency Services Limitation
Our ambulance dispatch service coordinates transport ONLY. For life-threatening emergencies, call your local emergency number (e.g., 999 in Kenya). OnLocum is NOT a substitute for emergency medical services.
6. Medical Transport & Logistics Services
6.1 Independent Contractors
Ambulance operators, transport crews, and logistics personnel are independent contractors or third-party providers, not employees of OnLocum. We are not responsible for their independent actions.
6.2 Safety
While we implement safety features (GPS tracking and provider verification), medical transport and logistics activities involve operational risk. Report safety concerns immediately.
6.3 Lost Items
OnLocum is not responsible for items left during transport or logistics operations. Contact the assigned provider directly through the app.
7. Payments and Fees
7.1 Payment Methods
We accept:
- Credit/debit cards (Visa, Mastercard)
- Mobile money (M-Pesa, Flutterwave)
- Wallet credits
7.2 Service Fees
Fees are displayed before booking confirmation. Prices may vary based on:
- Shift duration and role specialization
- Facility tier and trust configuration
- Urgency level and service type
- Market demand and worker availability
7.3 Commission
OnLocum applies tier-based commission on eligible services (typically 10-15%, depending on facility plan and worker source). Commission may be facility-paid or split by plan configuration.
7.4 Refunds
Refunds are issued for cancelled bookings according to our Cancellation Policy (Section 8). Processing time: 5-10 business days.
8. Cancellation Policy
8.1 Facility Cancellations
- Free cancellation: 24+ hours before scheduled shift
- Late cancellation: Within 24 hours may incur a fee (up to 50% of shift value)
- Emergency bookings: May carry stricter cancellation terms due to urgency and staffing impact
8.2 Worker and Provider Cancellations
Workers or service providers who cancel after acceptance may face:
- Account suspension
- Reduced priority in job matching
- Permanent deactivation (repeated violations)
9. Limitation of Liability
IMPORTANT LEGAL NOTICE
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLOCUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.
OnLocum's total liability shall not exceed the greater of:
- The amount you paid to OnLocum in the last 12 months, or
- KES 50,000 (Fifty Thousand Kenyan Shillings)
10. Indemnification
You agree to indemnify and hold OnLocum harmless from any claims arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your negligence or willful misconduct
11. Intellectual Property
All content, trademarks, logos, and intellectual property on OnLocum are owned by OnLocum or its licensors. You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks or branding
- Reverse engineer our software
12. Termination
12.1 By You
You may terminate your account at any time through app settings.
12.2 By OnLocum
We may suspend or terminate your account for:
- Violation of these Terms
- Fraudulent activity
- Safety violations
- Inactivity (90 days)
13. Dispute Resolution
13.1 Informal Resolution
Contact us at legal@onlocum.com to resolve disputes informally.
13.2 Arbitration
If informal resolution fails, disputes will be resolved through binding arbitration in Nairobi, Kenya, under Kenyan Arbitration Act.
14. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.
15. Changes to Terms
We may update these Terms at any time. We will notify you of significant changes via email or in-app notification. Continued use constitutes acceptance.
